SMITTY'S PRIVACY PROTECTION PLEDGE

At Smitty’s, we respect your privacy. That is why we have developed The Smitty’s Fine Furniture Privacy Code of which the objective is to specify Smitty’s guidelines for the collection, use and disclosure of your personal information.

The Smitty’s Fine Furniture Privacy Code was developed to comply with the relevant portions of the Personal Information Protection and Electronic Documents Act (Canada). We have drafted The Smitty’s Fine Furniture Privacy Code to facilitate our compliance with this new legislation and to demonstrate our commitment to protecting your personal information.

We have also developed The Smitty’s Fine Furniture Privacy Protection Pledge. We want you to understand the purposes for which we collect personal information. We also want to make certain that we have your consent to continue to collect, use and disclose your personal information for those purposes.

The following is a brief synopsis of our privacy practices:

Why do we need to collect your personal information?

If you are a Smitty’s customer, we may have collected some basic information about you. We respect your privacy, which is why we collect personal information only for the following purposes:

1. If you request us to deliver your goods and we are required to service them, we need your name, address, phone (work and home), cell phone, and detail driving directions to your home. We will collect your email address, with your permission, to increase the ways we can contact you regarding the delivery and/or service of the goods you purchase.

2. Your name, address and/or email address may be used to notify you of future sales and special events. At any time, if you do not wish to receive these types of notifications, simply notify our marketing department at media@smittysfinefurniture.com

3. If required, we collect your credit card information to provide you with a convenient method of paying for your purchase.

4. If you request to finance your purchase using a third party finance company, we collect your credit information and history. See specific information in the third party application form for more detail on the types of information the finance company requires to process your request for financing. As well, when you receive your new financing card, you will receive a package that outlines the principles they adhere to for protecting your personal information.

5. If you do not pay your entire balance for furniture you have received, and/or we are unable to contact you regarding your outstanding balance, we may forward your name, address and phone number to a third party collection agency, the Credit Bureau of Owen Sound.  We have a contract with this agency to act on our behalf to collect outstanding balances.  This agency would use your information and would adhere to their rights and policies as outlined in the province of Ontario Collection Agencies Act.  For more information on this act, please refer to the following website:

When do we disclose personal information?

Personal information is not disclosed to any third party other than agreements we have with our third party financing company and our collection agency. The completed application for third party financing, containing relevant credit information gets promptly sent to the finance company for their processing. We do not retain a copy at our premises. Please refer to the finance company’s relevant privacy commitments.  Also, please refer to the Credit Bureau of Owen Sound’s privacy policy and/or the Collection Agencies Act to determine how they use your information.  

Our Smitty’s Privacy Officer maintains the finance company and collection agency contact information so you can access their privacy commitments.

How do we protect your personal information?

In order to protect your personal information, Smitty’s:

1. Will not collect, use or disclose your personal information for any purpose other than those identified above, except with your further consent;

2. Will protect your personal information with appropriate security safeguards;

3. Will protect the confidentiality of your personal information when dealing with other organizations;

4. Will strive to keep your personal information as accurate and up to date as is necessary for the purposes identified above; and

5. Will honour any request you may make for access to your personal information.

What are your choices?

We would like to have your consent to continue to collect, use and disclose your personal information for the purposes identified above. However, you do have choices and can refuse or withdraw your consent as follows:

1. You may refuse to provide your personal information to us.

2. You may also withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice.

However, in either case, this may limit our ability to serve you.
