Terms of Sale for Smitty's Fine Furniture

Space Requirements Verify all your product specifications to the requirements and openings in your home and product site. Specifications are for planning purposes only and subject to change by manufacturer without notice. Smitty's will not be responsible for products that do not fit or that cannot be installed due to site limitations. We offer a free check measure service to ensure a successful delivery, please ask your sales consultant for details.

Online Orders Items displayed online may not be exactly as shown in the showroom. Fabric choices may be shown differently in our showroom than as pictured on our website. It is the responsibility of the customer to review product purchased with a sales consultant when order is confirmed. All items are subject to prior sale. Pricing is based on items as displayed in our showroom and is subject to change or correction.

Scheduling Your Delivery Once your product has arrived to our warehouse, our Delivery Department will contact you to schedule your delivery. On the business day prior to delivery, we will contact you again for final confirmation and to notify you of an estimated two‑hour delivery window. We do not deliver on Sundays or Mondays. You will have 30 days to schedule a delivery or arrange for pickup once your merchandise has been received in our warehouse. As a value‑added service, we will provide an additional 60 days of storage, providing your contract balance is paid in full. In the event you are unable to accept delivery by the end of the 90‑day period, long‑term storage fees will apply.

Preparing for Your Delivery Ahead of the delivery, please ensure the area where the product is to be placed is clear of obstructions and that the walkway and driveway are cleared of snow in winter. Ensure any items to be removed are easily accessible, and where applicable, disconnected (see terms for removal of appliances).

COVID‑19 We request that all customers respect social distancing and provide our teams with the space required to perform the delivery and set up. If you are feeling ill, or anyone in the household has had close contact with COVID‑19, please contact our Delivery Department to reschedule.

Best Price Guarantee We stand behind our prices and want to ensure your experience with us is worry free. If you find a lower price of the same product within 30 days of your purchase, including those advertised by Smitty’s, we will happily refund the difference. How it works Verify the price of an identical product, including model, fabric/finish grade and manufacturer and show your sales associate the proof of price. Acceptable proof of price includes live website prices, written pricing on competitor’s paperwork, or advertised printed pricing. We do not accept personal paperwork with handwritten prices, emails, or website screen shots.

Conditions of Price Matching

  • Products must be sold within Smitty’s regular delivery area
  • Products must be identical model number and manufacturer
  • Prices must be in Canadian dollars
  • For appliances, the product must be in stock, covered by manufacturers warranty, and available at the advertised price.

Price matching excludes all products sold as floor models, clearance, liquidation sales, “limited quantity” or “limited time offers”. All pricing online is based on items as displayed in our showroom and is subject to change or correction.

Delivery Services

Furniture Our delivery teams will set up furniture in place and remove all packaging. Our delivery personnel are not allowed to move any existing furniture or electronics. Please ensure that the space where your new furniture is going is cleared and accessible. We do not haul away old furniture.

Removal of Mattresses Upon delivery of a new mattress we will remove old mattresses which are free of stains for a small fee. A bag will be provided at the time of sale and we require that customers place the product in the mattress bag and seal it prior to removal. If the bag was not provided, a pickup of the mattress bag can be arranged through the Delivery Department.

Delivery of Appliances Appliance products will be left as close to the desired location as possible. We will remove all packaging, shipping bolts, and packing strips. The box, including the product information, will be left with the purchaser for warranty and claims purposes. Products can be left in the box if requested by the purchaser. For safety reasons Smitty's delivery personnel do not install, connect, or disconnect product from water, gas, or electrical sources, or install anti‑tip brackets or stack washers & dryers that require holes to be drilled. These services can be performed by a qualified installer of your choice.

Removal of Appliances The removal of an old appliance is on a one‑for‑one basis, at the time of delivery. If you would like an existing appliance removed, the pieces must be disconnected and/or drained. Old appliances will be removed if they are reasonably clean and if it is safe to do so. A damage waiver must be signed. Additional charges apply and services must be noted on invoice at time of sale. Smitty's reserves the right to refuse this service at time of delivery if deemed unsafe and service charge will be refunded.

Delivery of Outdoor Appliances Assembly services are available for BBQs or smokers and can be arranged at point of sale. Free delivery is available for products left in their original packaging and will be made to doorstep or garage. Our delivery team will not hook up or install connections to outdoor natural gas, electrical, or propane connections.

Return & Cancellations

In‑Stock Products A restocking fee (minimum 25% of purchase price) will apply to products authorized for return. All units requested to be returned to Smitty's must be in new condition and remain in original packaging (if delivered in original packaging), within 7 days of delivery or pick‑up.

Special Orders Special orders cancelled after production begins by the manufacturer, or after delivery to the customer (in good condition) are subject to a 50% re‑stocking fee. Smitty's reserves the right to decline returns of special ordered product.

Mattresses Mattresses that are sold with a mattress pad include a 30‑day "Mattress Comfort Guarantee". We will accept a return of the mattress for a credit toward the re‑selection of another mattress of equal or greater value as long as the mattress pad was used at all times. Refer to additional detail provided under the Mattress Comfort Guarantee information sheet available at time of sale.

Non‑Refundable Items All products marked "Final Sale" or "As Is" are non‑refundable as well as mattress pads, pillows, and yardage. Other services such as delivery charges, third‑party protection plans, extended warranty fees, are non‑refundable.

Defective/Damaged Products

Furniture If the product is damaged, you have the right to refuse the delivery. We will contact you to schedule another delivery. If you determine the product is defective upon arrival, please notify our Service team of the problem within 48 hours of receiving goods. After 48 hours, most of our furniture products include a one‑year parts and labour warranty, and will be taken care of by our Service Department. Please call 1-800-265-5533 ext. 4 or email service@smittysfurniture.com to register your request for service. We will schedule a service appointment within approximately five days of the issue being reported. We reserve the right to inspect, touch up, or repair an item before authorizing an exchange.

Appliances & Outdoor Appliances Purchaser must inspect every product at time of delivery or pick‑up. If a product is defective or damaged at such time, product must be refused and will be repaired or replaced in accordance with manufacturer warranties and policies. All delivery‑related issues must be reported & noted at time of delivery. If you notice damage on appliances and / or outdoor appliances it must be reported directly to the manufacturer within 48 hours of delivery.


Warranties on Furniture Smitty's Fine Furniture warranties all furniture, in residential use and still within our regular delivery area, against manufacturer's defect for one year, covering parts and labour. Professional repair, replacement, or refund is at the discretion of Smitty's Fine Furniture. Specifications and quality standards established by the manufacturer could vary. We honour manufacturer's warranties for longer than one year and will repair, replace, or refund as directed by the manufacturer. After one year there will be a charge for the service call and transportation of the product (if required) as determined by our Service Department. For products manufactured outside of Ontario, Smitty's reserves the right to have these products repaired instead of returned. Furniture sold from the Unloading Dock includes a 90‑day parts and labour warranty on defective products.

Exclusions on Furniture Warranty No warranty is extended to normal wear, everyday soilage, fading, or pilling of fabrics, damage due to negligence, misuse, accident, or the result of the customer's own transportation. Products outside our regular delivery area must be brought back to the nearest store or our warehouse by the customer. The customer is aware that Smitty's Fine Furniture offers for sale an extended furniture protection program, from a 3rd party provider, to protect merchandise beyond the manufacturer's warranty, and has made their own choice to accept or decline this offer. Products sold marked "As Is" or "Final Sale" do not include a warranty.

Warranties on Appliances & Outdoor Appliances Most of our large appliances come with a one‑year warranty on parts and labour (small appliances are typically up to 90 days unless otherwise stated). Outdoor appliances may include a longer warranty period. The customer is aware that any warranty claims on appliances, including outdoor appliances, are to be made directly with the manufacturer. The customer is aware that Smitty's Fine Furniture offers extended warranty plans for up to a total of 5 years of major appliances and has made their choice to accept or decline this offer.

Deposits & Final Payment

A non‑refundable 50% deposit is required on Special Order products. Orders must be paid in full 3 days prior to delivery or the delivery will be rescheduled to the next available opening.

Additional Policies

Additional policies and expanded explanations, as well as additional information about deliveries, pickups, and furniture orders, is available in the envelope provided with the copy of your order. It is the customer's responsibility to review this information.
